Modern businesses are inseparable from technology - it optimizes processes, automates operations, and drives innovation. However, alongside technological advancements come legal challenges, which are addressed by Tech Legal, also known as Technology law.

What Is Tech Legal?

Tech Legal is a legal field that encompasses all aspects related to the use of technology in business, including:

• Data protection and privacy regulations (GDPR and others)

• Intellectual property protection (patents, trademarks, copyrights)

• IT contract law (software licenses, SaaS agreements)

• Cybersecurity and liability for data breaches

• Legal aspects of artificial intelligence regulation

• E-commerce and fintech compliance

• Legal risks for startups and technology businesses

Examples of Tech Legal in Business

  1. TikTok – A National Security Threat?

U.S. and European authorities have investigated TikTok over suspicions that the platform’s collected user data could be transferred to the Chinese government. For now, the platform has avoided a complete shutdown, even though the U.S. Supreme Court upheld a law requiring TikTok to separate from its Chinese owner, ByteDance. On January 19, the app temporarily suspended its operations but was made available again just 12 hours later due to a 75-day extension granted by Donald Trump, allowing the owner time to find a buyer.

  1. GDPR Fine for Meta Over Illegal Data Transfers

In 2023, the European Union fined Meta (formerly Facebook) 1.2 billion euros for unlawfully transferring user data to the U.S. This was one of the largest fines ever issued for GDPR violations. The case highlighted the importance of adhering to international data protection laws.

  1. Google and Copyright Infringements in AI Training

Some publishers and authors have initiated legal actions against Google over its artificial intelligence models, which were trained using copyrighted content without explicit permission.

  1. Amazon and Fake Customer Reviews

Amazon has been accused of allowing fake customer reviews to flourish on its platform, with sellers manipulating ratings to artificially boost their product rankings. U.S. and EU regulators have launched investigations into misleading advertising practices.

Why Technology Law matters and what Companies should do

  1. Technology is evolving rapidly, requiring constant updates to legal regulations and the internal processes of businesses. Companies must actively monitor changes in legislation, regularly update their internal privacy, data protection, and technology use policies, and ensure that employees are properly trained to comply with new legal requirements.

  2. The risks associated with privacy, cybersecurity, and AI ethics are increasing. Businesses must invest in security measures, conduct regular cybersecurity audits, implement a robust data protection strategy, and ensure that artificial intelligence is used responsibly and ethically, in accordance with legal and moral standards.

  3. E-commerce and digital platforms are becoming an increasingly significant part of the economy. Companies must ensure that their digital services comply with legal requirements, maintain transparent data processing procedures, and adhere to e-commerce, consumer rights protection, and payment security standards.

Technology law is a dynamic field shaped by rapid changes in AI regulation, data privacy laws, and the integration of AI into the legal services sector. These trends are transforming not only legal practices but also requiring continuous adaptation to new legal challenges and opportunities.
